GENERAL INFORMATION AND ENLIGHTENMENT TEXT

This information and enlightenment text has been prepared by SAYGIN ÖZCAN ARCHITECTURE (SOAR) in accordance with the Personal Data Protection Law numbered 6698, accepted on 24/3/2016, and relevant legislation, for the purpose of informing and enlightening Data Subjects during the collection, obtaining, storage, sharing, and protection of personal data in compliance with the law.

In this context, in order to fulfill our enlightenment obligation according to Article 10 of the relevant law, this information text is presented to you for your information and examination with the conditions and purposes to be explained below, and the data to be processed lawfully.

Data Controller Definition:

As defined in Article 3 of Law No. 6698, the data controller is defined as "the real person or legal entity who determines the purposes and means of processing personal data and is responsible for establishing and managing the data recording system."

In this context, SOAR also has the responsibility as the Data Controller for the processing of personal data, and the fulfillment of the information and enlightenment obligation is ensured through this enlightenment text.

Legal Basis and Reasons for Processing Personal Data:

In cases where personal data, clearly defined in the Personal Data Protection Law No. 6698, is obtained, these data are processed within the scope of Articles 5 and 6 of the relevant Law. In this context, your personal data will be processed based on the legal reasons specified below, and in cases other than these specified legal reasons, your explicit consent will be requested for the processing of your Personal Data.

In accordance with the law, these legal purposes are:

  • To be able to provide information when requested by authorized public institutions and organizations, especially when requested by Courts and authorized public officials,

  • To fulfill legal obligations and to exercise the rights arising from the existing legislation,

  • Deemed necessary for the fulfillment of obligations arising from the establishment, performance, and conclusion processes of contracts,

  • Necessity for the establishment, use, or protection of the rights of our company, you, or third parties, provided that the fundamental rights and freedoms of the individual are protected, for the legitimate interests of our company, (conducting satisfaction evaluation activities of existing customers, organization and event management, conducting finance-accounting transactions, conducting audit processes, conducting occupational health and safety activities, fulfilling notification obligations to Courts, etc. authorized public institutions)

  • Necessity for the protection of life or bodily integrity of the data subject or someone else when it is impossible to obtain explicit consent due to physical impossibility or when consent is not legally valid,

  • Personal data having already been made public by the data subject,

  • Necessity for the establishment, use, or protection of a right,

These are the cases.

Personal Data outside the above-mentioned purposes will be processed upon the explicit consent of the data subject. Personal data obtained and to be processed within the framework of the Law may vary depending on the legal relationship between our company and the data subject. Personal data acquired by our company can be collected through different platforms (manual methods, verbal/written statements, electronic channels, forms on the SOAR website or through entry to pages using username and password, website visit and usage within the scope of activities and events carried out by our company).

Personal Data Collection and Processing Purposes

Depending on the nature of the Personal Data obtained by us through our website or other mentioned means, your Personal Data will be processed by us for the following purposes:

  • Planning, evaluation, and studies required by our business units to benefit our customers from the products and services we offer as SOAR,

  • Conducting advertising and marketing activities related to the services we offer and informing about similar issues, conducting corporate communication activities,

  • Conducting Marketing and Customer Relationship Management studies,

  • Organizing various events, campaigns, and invitations within the scope of corporate communication and informing about them, conducting market research studies,

  • Improving and personalizing digital platforms provided to our customers, if necessary, using cookies for this purpose,

  • Follow-up and evaluation of requests, suggestions, and complaints received from relevant individuals, customer management, and planning in this context, conducting evaluation studies in every field,

  • Ensuring the sustainability of all activities carried out within the scope of SOAR, making improvements, and auditing individuals and companies with whom contractual relationships are established,

  • Ensuring the legal and commercial security of individuals and companies within the scope of SOAR's business-service relationship,

  • Planning and execution of occupational health and safety processes,

  • Using the information to exercise legal rights, using information about transaction history as evidence in case of disputes after the end of the legal relationship with the individual/institution,

  • Planning, reporting, visitor/customer statistics, and similar examinations of activities, and/or compliance with domestic regulations, provision of information requested by public institutions and organizations, fulfillment of reporting obligations.

Verification of Data Subject's Rights

The rights of natural/legal persons whose personal data is processed under the Personal Data Protection Law No. 6698 are as follows:

  • To learn whether personal data is processed,

  • Requesting information if personal data has been processed,

  • To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

  • Knowing the third parties to whom personal data is transferred domestically or abroad,

  • Requesting correction of personal data if it is incomplete or incorrectly processed, and requesting notification of the transaction made in this context to third parties to whom personal data has been transferred,

  • Requesting the deletion or destruction of personal data in case the reasons requiring their processing disappear despite being processed in accordance with the Law and requesting notification of the transaction made in this context to third parties to whom personal data has been transferred,

  • To object to the emergence of a result against the individual by analyzing the processed data exclusively through automated systems,

  • Requesting compensation in case of damage due to unlawful processing of personal data.

For the use of the above-mentioned rights, distinctive identity/registration information and explanations regarding the desired right and this matter should be sent in writing, and according to Article 11 of the Personal Data Protection Law No. 6698, if sent to the address of SOAR, which is the headquarters address, "Göztepe Mahallesi Pınar Sokak Uyumpalas Apt 18/B Kadıköy/Ä°stanbul" by registered mail, it will be processed.

Evaluation of Data Subject Requests

In accordance with the 1st paragraph of Article 13 of Law No. 6698, requests regarding the use of the rights mentioned above, after being forwarded to our company through written or other methods determined by the Personal Data Protection Board, will be concluded as soon as possible free of charge (However, if the transaction requires an additional cost, a fee may be charged according to the tariff determined by the Board), and a response will be provided to you via the contact information you have provided.
